Cryptocurrency prices climbed sharply this week after President Donald Trump, flanked by digital-asset executives at the White House, renewed his push for Congress to pass legislation that would create the first comprehensive federal framework for much of the industry.
Bitcoin rose to its highest level since early June, extending a two-day rally of roughly 12 percent, while ether also surged after Mr. Trump urged lawmakers to approve what he called a “fair version” of the CLARITY Act. The burst of market optimism reflected a familiar pattern in crypto: prices moving not only on technology and trading flows, but also on shifting expectations that Washington may finally deliver rules the industry has demanded for years.
Yet even as investors cheered the prospect of clearer oversight, federal regulators were sending a more complicated message. On Thursday, the Commodity Futures Trading Commission used the first meeting of its Innovation Advisory Committee to examine emerging risks in prediction markets, highlighting concerns about consumer protection, market integrity and manipulation in a fast-growing corner of digital finance.
Taken together, the developments underscored a pivotal moment for U.S. crypto policy — one defined not by simple deregulation, but by a simultaneous push to legitimize parts of the market while tightening scrutiny elsewhere.
A late push for the CLARITY Act
The legislation at the center of the market rally, H.R. 3633, the Digital Asset Market Clarity Act of 2025, would draw a more explicit line between the jurisdiction of the CFTC and the Securities and Exchange Commission. In broad terms, it would place most so-called digital commodities under the CFTC’s supervision while preserving SEC authority over other crypto assets that meet the definition of securities.
That division has long been one of the industry’s central demands. Crypto companies have argued for years that the absence of a clear federal market structure has left firms and investors navigating overlapping claims, legal uncertainty and an enforcement-first approach from regulators.
The bill had already cleared the House and moved through part of the Senate process, but lawmakers left Washington for recess without finishing it. Senate leadership has set a cloture vote on the motion to proceed for Sept. 15, making the coming weeks critical for supporters trying to build the 60 votes needed to move the measure forward.
Mr. Trump’s intervention appeared aimed at injecting urgency into that effort. Industry executives, too, have been making a last-minute case that the Senate should not let the measure stall after years of lobbying for federal guardrails that could allow more institutions to enter the market with confidence.
Investors appeared to take the White House push as a sign that the bill still has a path, however narrow, through Congress.
What the market is betting on
The rally in Bitcoin and ether reflected more than enthusiasm over a single legislative event. It also suggested that traders see the CLARITY Act as a potential turning point for the domestic crypto business.
If enacted, the legislation could make it easier for exchanges, token issuers and trading platforms to understand which regulator they answer to and which rules apply. That clarity could lower legal risks for companies that have hesitated to expand in the United States and could encourage fresh institutional participation in digital-asset markets.
For Bitcoin and ether, the two largest cryptocurrencies, that prospect matters because broad regulatory uncertainty has often weighed on sentiment even during periods of stronger demand. A workable federal framework would not eliminate volatility, but it could reshape how investors value the sector by making it look less like a legal gray zone and more like an established financial market.
Still, the bill’s fate remains uncertain. Some of the late-summer resistance has centered on ethics and conflict-of-interest concerns tied to Mr. Trump’s own crypto connections. Other disputes, including disagreements related to stablecoins, could complicate the coalition needed to advance the measure in the Senate.
A parallel warning from regulators
While the market focused on the possibility of friendlier legislation, the CFTC meeting made clear that regulators are not stepping back from oversight.
The agency’s Innovation Advisory Committee, convening for the first time, turned its attention to prediction markets, an area that has expanded rapidly as platforms offer contracts tied to elections, economic releases, sports-like events and other outcomes that can attract retail traders. Committee members raised the possibility that these products, especially when paired with promotional incentives, may create new risks for consumers and open avenues for manipulation or abusive practices.
The discussion followed recent CFTC staff advisories addressing event-contract and incentive-program concerns, signaling that the commission is paying closer attention to products that blur the line between regulated derivatives and something more akin to gambling.
That matters because prediction markets occupy one of the murkiest boundaries in modern financial regulation. Supporters say they can serve as valuable tools for hedging and price discovery. Critics argue that some contracts are speculative retail products with limited economic purpose and significant potential for harm.
The commission’s scrutiny suggests that even if Congress moves toward a more accommodating market structure for core crypto assets, Washington may also become tougher on newer, retail-facing products that test the edges of existing law.
The broader policy moment
The tension between those two signals — encouragement for one part of the digital-asset economy, sharper oversight for another — captures the current stage of U.S. crypto policymaking.
For much of the past decade, the industry’s argument has been that it cannot mature in the United States without rules tailored to digital assets. The CLARITY Act represents the most serious congressional attempt yet to answer that demand by assigning primary oversight of many tokens to the CFTC and reducing the jurisdictional ambiguity that has plagued the sector.
But the CFTC’s focus on prediction markets shows that “clarity” is not synonymous with laissez-faire. Regulators are also trying to define where guardrails should be stronger as digital platforms reach more ordinary consumers and as speculative products proliferate.
That dual track could shape not only crypto trading, but the future of financial innovation more broadly. If Congress fails to act, questions will remain about how far agencies can go on their own using existing authority. And if the CFTC decides that current risks in prediction markets require more aggressive enforcement, new rulemaking or court fights could follow.
For now, the market is trading on hope that Washington is inching toward a durable framework. Whether Congress can translate that optimism into law — and whether regulators can draw workable lines around the next generation of crypto-adjacent products — will determine whether this week’s rally marks a lasting shift or just another burst of enthusiasm in a still unsettled industry.
