The New Geography of Tech Controls
The latest skirmishes in the technology contest between the United States and China are no longer defined only by headline-grabbing bans. Increasingly, they are being fought in licensing agreements, shipping documents and corporate structures spread across third countries.
Three recent developments — a patent deal between HP and Huawei, criminal charges in Taiwan over the alleged smuggling of advanced AI servers to China, and a push to use Singapore as a bridge for Chinese robotics startups seeking American customers — point to the same underlying reality: restrictions meant to sever technological ties are often producing new pathways rather than clean breaks.
That shift matters because it suggests the contest is moving beyond straightforward questions of whether a company is blacklisted or a product is banned. The harder questions now involve where technology is developed, who controls it, how it is licensed and where it ultimately ends up.
A Blacklisted Company’s Technology Still Travels
On Tuesday, HP and Huawei announced a multiyear global patent cross-licensing agreement that includes HP licensing certain Huawei Wi-Fi patents, an arrangement that underscored how a company shut out of much of the American supply chain can still exert influence through intellectual property.
Huawei has remained a central target of U.S. restrictions for years, with Washington barring American suppliers from many forms of business with the Chinese telecommunications giant and pressing allies to limit its role in critical networks. Yet blacklisting has never fully erased Huawei from the global technology system. Its vast patent portfolio, especially in communications standards, has given it another route into international markets.
The agreement with HP followed earlier litigation over Wi-Fi technology, and it reflects a broader effort by Huawei to expand its patent-licensing business as other avenues narrowed. For Western companies, such deals can be legally and commercially distinct from selling chips or software to a sanctioned entity. For policymakers, however, they illustrate a more complicated picture: even when the flow of products is constrained, the flow of underlying technology rights may continue.
That distinction is likely to draw greater scrutiny as governments try to determine whether existing tools are suited to a world in which influence can travel by patent as much as by part number.
Demand for AI Hardware Has Not Let Up
If the HP-Huawei deal showed one lawful route around geopolitical separation, the case in Taiwan highlighted a more clandestine one.
Taiwanese prosecutors said this week that they had charged nine people over the alleged illegal export of 130 high-end AI servers to mainland China, including employees from the Taiwan units of Nvidia and Super Micro. Prosecutors said the servers used Nvidia B300 graphics processing units, advanced chips barred from sale to China under U.S.-led controls, and that the scheme involved false end-user arrangements and forged documentation.
The case, if proved, would offer a vivid example of the pressure that export controls have put on one of the world’s most sought-after technologies. Advanced AI chips and the servers built around them have become essential to training and deploying frontier AI systems, and Chinese companies have spent years trying to secure access as Washington tightened restrictions.
Taiwan occupies a particularly sensitive place in that struggle. It sits at the center of the global semiconductor supply chain and has become a crucial enforcement point for measures designed to keep cutting-edge computing power out of China’s hands. Any alleged effort to move restricted AI systems through falsified paperwork strikes at the credibility of that enforcement architecture.
It is not yet clear whether prosecutors have uncovered a broader trafficking network or a narrower operation involving a handful of individuals. But the charges suggest that the commercial incentives to evade the rules remain powerful, particularly as AI competition between Washington and Beijing intensifies.
Singapore’s Appeal as a Middle Ground
At the same time, investors and startup backers are searching for legal ways to reposition Chinese technology companies outside the direct path of U.S. restrictions.
In robotics, some investors have been promoting Singapore as a base from which Chinese startups with meaningful engineering and commercial operations in the city-state might still reach U.S. buyers, even as Washington moves to exclude Chinese-made robots. A Temasek-backed investor behind Unitree, the Chinese robotics company known for its humanoid and quadruped machines, has been among those making that case.
The strategy has gained urgency since the United States moved on July 28 to ban imports of new Chinese humanoid and quadruped robots, a measure expected to hit companies like Unitree and further widen the commercial divide between the two countries. Singapore, with its reputation for regulatory predictability, strong investor networks and role as a regional business hub, is being presented as a place where Chinese companies can establish substantive operations and potentially recast how they are viewed by customers and regulators.
Whether that approach succeeds may depend on how U.S. authorities define the line between legitimate international expansion and circumvention. A company that hires engineers, builds products and books sales through Singapore may argue that it is creating a genuine multinational business. Critics may ask whether the core ownership, control or strategic direction still rests in China.
That ambiguity is likely to become more consequential as restrictions spread from chips and telecommunications into newer fields like robotics.
From Bans to Boundary-Testing
Taken together, the three episodes show how companies and intermediaries are adapting to a more fragmented global technology order.
The old assumption behind many sanctions and export controls was that governments could restrict access by targeting a company, a category of hardware or a destination country. That approach still matters, and in some areas it has clearly bitten. But the response from industry has been to test the seams: use patent licensing where components are blocked, rely on false paperwork where demand overwhelms deterrence, or build operations in third countries where origin becomes less clear.
That does not mean the restrictions are ineffective. In many cases, they have forced costly restructuring and narrowed China’s direct access to advanced U.S. technology. But they have also created a new compliance battleground, one centered less on simple prohibition than on tracing ownership, end use and commercial substance.
For regulators, that means enforcement is getting harder. For companies, it means legal exposure is rising alongside pressure to find workarounds. And for the broader global technology industry, it means the separation between the American and Chinese ecosystems is proving neither complete nor clean.
Instead, it is being renegotiated in contracts, customs channels and corporate maps — one workaround at a time.
